HERE’S A SUMMARY OF THE PROCESS OF MAKING A CLAIM, AND THE SERVICES WE PROVIDE.
Making a Claim and Fees
Upon instructing us you agree to pay an initial fee of £300 and we will forward you an information form for you to complete about your claim from which we would draw up the court papers and claims form in draft for you to confirm as correct. A copy of this claims form will then be sent by you to the defendant with a letter demanding full payment or an agreement to pay acceptable to you within 14 days.
If payment is received IN FULL within the 14 days or an acceptable payment agreement is reached then that is the end of the claim. You will not pay us any further sum and all the proceeds will come directly to you. We are not a Claims Company and do not touch any of your money received.
If payment is not received you have the option to continue the case to court when you will pay us the second part of our fee of £300 (£400 for claims over £5000) and we will prepare the original documents for issuing through the Court with instructions of which court to send these with any relevant exhibits. As this is your claim you will be required to sign a statement of truth that all details contained are true,
There will be a court fee to pay directly to the court details of which are on the page marked court fees and these fees will be repaid back to you if your claim is successful at the discretion of the court.
If payment is not received within 28 days nor any defence submitted you can apply to the Court for judgement, if the Defendant submits a defence there will be a trial of the issues in Court which you would have to attend in person to argue your claim in front of a District Judge.
The Small Claims Courts are an informal way of dealing with disputes between Claimants and Defendants after which the District Judge would make a decision.
Court Hearing Representation by Barrister or Solicitor
Small Claims cases are intended to be contested by litigants in person rather than engaging legal representation, as such fees whether win or lose cannot be recouped. However, we can offer a service, where a qualified legal representative will if required represent you in court. This will be subject to availability and a fixed quotation depending on the length and complexity of your case.
